§ 1 General Provisions, Scope, House Rules

  1. These Terms and Conditions govern the legal relationship between RELAX POINT (operator: Ahmad Almahairi) and the customer as well as accompanying persons (collectively referred to as the “Customer”) in connection with online booking, the use of massage chairs, and other services.
  2. All agreements between the Customer and the Operator arise exclusively from these Terms and Conditions and the written booking confirmation.
  3. Additionally, the rules of the house regulations (House Rules) apply in their current version. In the event of contradictions, these Terms and Conditions shall prevail.
  4. The inclusion of the customer’s own general terms and conditions is expressly excluded.
  5. These Terms and Conditions apply equally to consumers and businesses.

§ 2 Registration and Access

  1. The Customer is obliged to provide complete and truthful information during registration.
  2. The Customer is responsible for maintaining the confidentiality of their login credentials; use by third parties is at the Customer’s own risk.
  3. In the event of violations, the Operator reserves the right to temporarily or permanently block the Customer.
  4. Registration is completed by clicking the “Register” button.
  5. Multiple registrations using different email addresses are prohibited; any resulting costs shall be borne by the Customer.
  6. The Operator is not obliged to accept every registration or booking.

§ 3 Conclusion of Contract

  1. The services, appointments or times presented on the website do not constitute a binding offer. A contract is concluded only upon written booking confirmation.
  2. Booking process: Select service → enter personal data → select payment method → review order → accept Terms & House Rules → payment → booking confirmation.
  3. By completing the booking, the Customer agrees to these Terms and Conditions, the House Rules, and the Privacy Policy.

§ 4 Prices and Payment

  1. All prices include VAT and apply at the time of booking.
  2. Payments are made exclusively online (credit card, PayPal, vouchers). On-site payments are not permitted.
  3. The Operator reserves the right to adjust prices after the conclusion of the contract if legally permitted reasons arise.

§ 5 Use of Services and Customer Responsibility

  1. The service begins upon the Customer’s arrival.
  2. If the Customer is late, the usage time will be reduced accordingly; full fees may still be charged if subsequent bookings are affected.
  3. The Operator may refuse services for health or hygiene reasons. Refunds or compensation are excluded.
  4. If the service cannot be provided due to the Customer’s behavior, the full service fee (100%) must be paid.
  5. Vouchers and sold items remain the property of the Operator until full payment is received.

§ 6 Personal Belongings and Liability

  1. Bags and personal belongings may only be stored near the massage chair.
  2. Outerwear and shoes must be stored exclusively in the designated area at the entrance.
  3. RELAX POINT assumes no liability for loss, theft, or damage to personal belongings except in cases of intent or gross negligence on the part of the Operator.
  4. The Customer is fully responsible for cash, valuables and electronic devices.

§ 7 Hygiene, Conduct and House Rights

  1. Shoes must be removed when entering the studio; massage chairs must be cleaned after use with the provided disinfectant wipes.
  2. RELAX POINT is a relaxation and recovery zone; respect for other guests and maintaining a quiet environment are mandatory.
  3. The following are prohibited: noise, aggressive behavior, violations of order or morality, smoking (including e-cigarettes), animals, essential oils or other substances, consumption of food and drinks at the massage chairs.
  4. In case of violations, the Operator may immediately terminate the service and issue a ban from the premises.

§ 8 Damages, Liability and Health

  1. The Customer is fully liable for damage to equipment, furniture or premises.
  2. Costs for repair, replacement or professional cleaning shall be borne by the Customer.
  3. RELAX POINT is only liable for damages to life, body or health in cases of intent or gross negligence.
  4. In the event of breach of essential contractual obligations, liability is limited to foreseeable damages typical for the contract unless intentional or grossly negligent misconduct exists.
  5. The use of all massage chairs is at the Customer’s own risk.
  6. If the Customer has health restrictions, it is recommended to consult a doctor before using the service.

§ 9 Technical Problems and Force Majeure

  1. The Operator is not liable for outages, technical failures or force majeure.
  2. Appointments may be rescheduled; amounts already paid will be refunded in the form of a voucher.

§ 10 Cancellation

  1. Free cancellation: at least 24 hours before the appointment → refund as voucher.
  2. Late cancellation or no-show → no entitlement to refund or replacement service.
  3. If the service cannot be provided by the Operator → free replacement service at a new appointment.

§ 11 Right of Withdrawal

According to § 312g paragraph 2 no. 9 of the German Civil Code (BGB), there is no right of withdrawal for services provided at a specific date or time (e.g. massage slots or packages).

§ 12 Alternative Dispute Resolution

  2. The Operator is not obliged to participate in consumer dispute resolution procedures.

§ 13 Written Form, Severability Clause

  1. Amendments or additions to these Terms and Conditions or the contract must be made in writing.
  2. If individual provisions are invalid, the validity of the remaining provisions shall remain unaffected; they shall be replaced by economically equivalent clauses.

§ 14 Place of Performance, Jurisdiction, Applicable Law

  1. Place of performance: Dresden, Germany
  2. Exclusive place of jurisdiction: Dresden, Germany
  3. Applicable law: Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
